Although bail works the same in most parts of the country, each individual state regulates its own bail bond industry using its state department/division of insurance. Bail bonds in Las Vegas are thus regulated by the Nevada Division of Insurance under the Nevada Department of Business and Industry.

In Las Vegas, many misdemeanors, gross misdemeanors, and felonies have automatic bail amounts, so often a person can immediately post bail after being booked. If a person then misses a court date, the bail money can be forfeited. On the other hand, if the defendant appears on time to all court dates, bail money is returned regardless of the case’s result.
If someone can’t afford or just doesn’t want to pay the whole bail amount to the jail, they have the option of using a bail bondsman who will put up the entire amount on their behalf. In Nevada, the mandatory fee a bondsman collects for this service is 15% plus court filing fees (typically $40 per charge). A bail bonds company has a financial interest in insuring the defendant’s appearances in court for if the arrestee fails to appear in court, the bail bond can be forfeited and cashed by the court. **

First and foremost, select a lawyer who focuses on the Greater Las Vegas area. If the business card doesn’t say area code “702” keep looking! Ask him or her if they have experience in situations like yours. Make sure they have time for you and haven’t overloaded themselves with cases.
Surprisingly former public defenders (who now practice private criminal defense law) can make some of the most efficient attorneys for our clients. Generally, they show great skill and can leverage their sometimes vast experience to your defense.
One of the more obvious pointers is to rely on a personal referral from a friend or family member who had success with a particular law office with a related case. In case you don’t have a personal referral, look to online reviews and testimonials on sites like Google Places, Yelp, Kudzu, etc.
